In 1972 James Rachels published a challenging criticism of moral-point-of-view theories. It has never been answered. This is sur-prising, given that the species of theory to which it applies remains alive. In this paper I reply to Rachels’ criticism. My reply refers frequently to the work of G. J. Warnock and employs three distinctions that have been overlooked in the literature on moral-point-of-view theories. These dis-tinctions have relevance to more than Rachels’ paper. In this paper I distinguish moral “ought”-judgments, meaning “ought”- judgments that qualify as moral judgments, from “morally ought”-judgments, meaning “ought”-judgments whose “ought” is either prefaced (or followed) by the word “morally” or construable as so prefaced. Specifically, I argue that the former class of judgments is wider than the second. (As I show in section 3, this is not to argue for the already familiar distinction, or putative distinction, between a broad and a narrow sense of “moral.”) I also speculate (...) as to why the distinction exists, and, more important, show that it has important consequences. Can a competent individual refuse care in order to make their natural death reasonably foreseeable in order to qualify for medical assistance in dying (MAiD)? Consider a competent patient with left-side paralysis following a right brain stroke who is not expected to die for many years; normally his cause of death would not be predictable. However, he refuses regular turning, so his physician can predict that pressure ulcers will develop, leading to infection for which he will refuse treatment and consequently (...) die. Is he now eligible for MAiD? Consider a competent patient with spinal stenosis (a non-fatal condition) who refuses food (but not liquids in order not to lose capacity from dehydration). Consequently, her physician can predict death from starvation. Is she now eligible for MAiD? Answering these questions requires that we answer three sub-questions: 1) do competent patients have the right to refuse care?; 2) do healthcare providers have a duty to respect such refusals?; and 3) are deaths resulting from refusals of care natural for the purposes of determining whether a patient is eligible for MAiD? If a competent patient has the right to refuse some particular care, and healthcare providers have a duty to respect that refusal, and if the death that would result from the refusal of that care is natural, then that refusal of care is a legal pathway to MAiD. However, if the competent patient does not have the right to refuse some particular care, or if healthcare providers do not have a duty to respect that refusal, or if the death that would result from the refusal of that care is not natural, then that refusal of care is not a legal pathway to MAiD. Introduction: Previous findings that inattention and hyperactive/impulsive symptoms predict later peer problems have been mixed. Utilizing two culturally diverse samples with shared methodologies, we assessed the predictive power of dimensionally measured childhood IA and HI symptoms regarding adolescent peer relationships.Methods: A US-based, clinical sample of 228 girls with and without childhood diagnosed attention-deficit/hyperactivity disorder was assessed and followed 5 years later. A Norwegian, population-based sample of 3,467 children was assessed and followed approximately 4 years later. Both investigations used parent and (...) teacher reports of ADHD symptoms and peer relations. Multivariate regression analyses examined the independent contributions of IA and HI symptoms to later peer problems, adjusting for baseline childhood peer problems. We also examined childhood sex as a potential moderator within the Norwegian sample.Results: Higher levels of childhood HI symptoms, but not IA symptoms, independently predicted adolescent peer problems in the all-female clinical sample. Conversely, higher levels of IA symptoms, but not HI symptoms, independently predicted preadolescent peer problems in the mixed-sex population sample. Results did not differ between informants. Associations between ADHD symptom dimensions and peer problems within the Norwegian sample were not moderated by child sex.Discussion: Differential associations between childhood hyperactive/impulsive and inattention symptoms and adolescent peer problems were found across two diverse samples using a shared methodology. Potential explanations for different findings in the clinical vs. population samples include symptom severity as well as age, sex, and cultural factors. We discuss implications for future research, including the importance of dimensional measures of ADHD-related symptoms and the need for shared methodologies across clinical and normative samples. Introduction: Emotional fluctuations and mood swings are common among adults with Attention Deficit/Hyperactivity Disorder. Here we investigated if these problems could be retrospectively traced back to childhood behavior.Methods: Adults with an ADHD diagnosis and a population-based control sample completed the Adult ADHD Self-report Scale, the Wender Utah Rating Scale and the Mood Disorder Questionnaire. All participants also provided self-reported information about co-existent psychiatric and somatic diseases, and demographic data. Reports on the MDQ were used to define subgroups with [MDQ] and (...) without [MDQ] life-time periods of emotional fluctuations and the WURS scale was used to retrospectively assess childhood ADHD related behaviors and symptoms.Results: 50.2% of the ADHD group and 5% of the controls were defined with emotional fluctuations [MDQ]. Childhood behavior ratings of “impulsivity,” “loosing of control,” and “trouble with authorities” independently predicted emotional fluctuations reported in adulthood via logistic regression analyses. Inclusion of these three items in a classification analysis gave an accuracy score around 70% in identifying each of the two MDQ categories in the ADHD group.Discussion: The strong association between self-reported features of emotional problems in childhood and in adulthood suggests a trajectory that should be detected and remediated at an early age. Future longitudinal studies should prioritize the examination of developmental mechanisms explaining the persistence of emotional problems from childhood into adulthood. (shrink)

Despite the prevalence of beliefs across religions regarding repentance and divine forgiveness and their recognition in theoretical and religious studies, these constructs are relatively understudied phenomena in the social sciences. Furthermore, in recent years, multiple scholars have argued for the need for research to systematically study and highlight the experience and processes of repentance and divine forgiveness. Subsequently, this study explored processes of repentance, antecedents and motivations of repentance, resources to aid in repentance, and outcomes of repentance that should be (...) further examined. This analysis was done using in-depth qualitative interviews with 15 emerging adult religious exemplars identifying with the Church of Jesus Christ of Latter-day Saints. The authors used NVivo 12 and team-based qualitative coding processes to identify themes. Repentance processes included personal change, took various lengths of time, were a part of participants’ religious identity, were recurrent processes, and were influenced by participants’ view of God. Antecedents and motivations included religious practices and rituals, emotions, interpersonal interactions, and their relationship with God. Resources that aided in repentance included religious practices and rituals, interpersonal relationships, and a relationship with God. Finally, participants reported experiencing personal changes in their behavior and character, positive emotions (including feelings of divine forgiveness), improved interpersonal relationships, and a better relationship with God. These processes align with some previously discovered and theorized findings on repentance, contribute a number of novel findings, and offer future direction regarding the motivations, resources, and transformative experiences that participants reported in their personal repentance and experience of forgiveness. ABSTRACTThis report on end‐of‐life decision‐making in Canada was produced by an international expert panel and commissioned by the Royal Society of Canada. It consists of five chapters.Chapter 1 reviews what is known about end‐of‐life care and opinions about assisted dying in Canada.Chapter 2 reviews the legal status quo in Canada with regard to various forms of assisted death.Chapter 3 reviews ethical issues pertaining to assisted death. The analysis is grounded in core values central to Canada's constitutional order.Chapter 4 reviews the (...) experiences had in a number of jurisdictions that have decriminalized or recently reviewed assisted dying in some shape or form.Chapter 5 provides recommendations with regard to the provision of palliative care in Canada, as well as recommendations for reform with respect to the various forms of assisted death covered in this document. Aux origines de la phénoménologie et de la philosophie analytique, il s'agit ici de livrer une analyse détaillée des Recherches logiques de Husserl, centrée sur le concept d'intentionalité, sur ses usages et sa structure. L'intentionalité telle que la construit alors Husserl est étudiée dans sa détermination fondamentalement sémantique, et on interroge systématiquement le rapport qu'il y a, dans les Recherches, entre la théorie de l'intentionalité et la théorie de (...) la référence linguistique. Cette étude débouche sur une comparaison de fond entre les doctrines de Husserl et de Frege et leurs implications respectives pour la philosophie du langage aujourd'hui - jusqu'à la remise en question, à la lumière de Frege, des insuffisances d'une pensée de l'intentionalité. La question peut alors se poser de la possibilité d'inventer une autre phénoménologie (qui ne passerait plus primairement par le concept d'intentionalité), à élaborer dans une nécessaire confrontation avec les philosophies du langage contemporaines. Meat is a multi-billion-dollar industry that relies on people performing risky physical work inside meat-processing facilities over long shifts in close proximity. These workers are socially disempowered, and many are members of groups beset by historic and ongoing structural discrimination. The combination of working conditions and worker characteristics facilitate the spread of SARS-CoV-2, the virus that causes COVID-19. Workers have been expected to put their health and lives at risk during the pandemic because of government and industry pressures to keep (...) this “essential industry” producing. Numerous interventions can significantly reduce the risks to workers and their communities; however, the industry’s implementation has been sporadic and inconsistent. With a focus on the U.S. context, this paper offers an ethical framework for infection prevention and control recommendations grounded in public health values of health and safety, interdependence and solidarity, and health equity and justice, with particular attention to considerations of reciprocity, equitable burden sharing, harm reduction, and health promotion. Meat-processing workers are owed an approach that protects their health relative to the risks of harms to them, their families, and their communities. Sacrifices from businesses benefitting financially from essential industry status are ethically warranted and should acknowledge the risks assumed by workers in the context of existing structural inequities. In addition to its recognition of the role of evolutionary pressures in the emergence of human morality, contextual constructivism must now clarify the role of historical intersubjectivity in the subsequent development of morality. I will then claim that adding a coherentist module to Humean constructivism provides a satisfactory answer to those who fear that contextual metaethical theories can only be non-cognitivist. Finally, I will sketch out why I think that the notion of a mind-independent “space of moral reasons” is largely compatible with Humean constructivism. (shrink)

Jocelyn Maclure | : Alan Patten’s Equal Recognition is a major contribution to the normative literature on minority rights. I nonetheless suggest that liberal culturalism as a normative theory, even in Patten’s sophisticated version, is ill suited to deal with the challenges related to the status of religion in the public sphere that are so prevalent in contemporary democracies. In addition, I submit that Patten did not supply a fully convincing answer to the argument that liberal egalitarianism, well understood, (...) is capacious enough to secure fair terms of social cooperation for members of cultural minorities, making the language of “cultural rights” and “cultural recognition” superfluous. | : Le livre Equal Recognition d’Alan Patten contribue de façon majeure aux travaux de philosophie politique sur les droits des minorités culturelles. Je suggère néanmoins que la théorie normative qu’est le « culturalisme libéral », y compris dans la version sophistiquée défendue par Patten, n’est pas outillée pour penser les omniprésents défis concernant le statut de la religion dans l’espace public. De plus, j’avance que Patten n’a pas été en mesure d’offrir une réponse pleinement satisfaisante à ceux qui soutiennent que l’égalitarisme libéral bien compris est en mesure d’offrir des termes de coopération sociale justes aux membres des minorités culturelles, sans devoir être complété par des « droits culturels » ou par le langage de la « reconnaissance » des cultures. Le public spécialisé, non moins que le grand public cultivé, attendait depuis longtemps une réédition du Mystère apocryphe, cette introduction à une littérature proche de la Bible, devenue un classique. Depuis septembre 2007, c’est donc chose faite et l’on ne peut que s’en réjouir, d’autant que l’ouvrage a vu ses bibliographies enrichies et actualisées, et qu’il a été aug­menté d’un essai sur l’évangile de Judas. L’on se plaira à souligner l’intérêt de ce livre, aujourd’hui peut-être plus enc.

J’arguerai ici que tout en repoussant d’une main une conception du changement social basé sur la sélection naturelle des pratiques sociales et des individus qui y participent, les théories normatives qui font appel à des modélisations des choix sociaux, qu’ils soient de nature économique, politique ou morale, en entretiennent potentiellement les conséquences. Plus précisément, j’arguerai que les modèles que l’on utilise encore le plus volontiers dans les sciences sociales, c’est-à-dire ceux de la théorie des jeux, de la théorie de la (...) décision ou de la négociation rationnelle, contribuent à répercuter, au plan normatif, les deux aspects — social et individuel — de la sélection naturelle. L’argument s’appuie sur une analyse de la théorie standard de l’utilité et montre que la conception de la rationalité maximisante définie dans ce cadre formel incorpore les exigences de la sélection à celles de la rationalité.I shall argue that though most theoreticians of social change firmly refuse normatively to endorse the natural selection of practices and individuals, they sometimes tacitly validate the consequences of such a conception of social change. More precisely, I shall argue that the formal apparatus still often used in social sciences — such as game theory, bargaining theory or decision theory — contribute to carrying on, at the normative level the social and individual aspects of natural selection. The argument rests on an analysis of what has come to be regarded the standard theory of utility and attempts to show that maximising rationality defined in that framework incorporates the requirement of the selection to those of rationality. L'hypothèse qui guide le présent article est que les méthodes et techniques de dérivation ou de modélisation utilisées en éthique contemporaine, ont une incidence sur les contenus proprement moraux de la théorie morale ; vues comme de simples outils à l'usage du philosophe moral, elles agissent en fait comme des sources de normativité morale. Cette hypothèse n'est pas une simple reformulation de l'idée voulant qu'il existe, au sein de la théorie morale, un rapport entre explication et justification ou entre méta-éthique (...) et éthique. Pour le montrer, je m'appuierai d'abord sur une caractéristisation générale de ces composantes de la théorie morale et des rapports qu'elles entretiennent entre elles. Dans un deuxième temps j'arguerai que l'usage d'outils méthodologiques particuliers peut avoir une incidence sur les contenus moraux proprement dits. Pour caractériser cette incidence et en décrire les mécanismes, je ferai d'abord appel à une approche pragmatique de l'explication, puis je donnerai deux exemples, tirés de la philosophie morale contemporaine, et illustrant le fait que certains contenus moraux ainsi introduits échappent de fait à une justification en bonne et due forme.The central claim made in this article is that the various methodological devices used by contemporary moral philosophers in order to represent or derive moral principles affect the very moral content of their theory; seen by them as mere tools for philosophers, they in fact are sources of moral normativity. This claim is not a mere reformulation of the idea that there is within moral theory a connection between explanation and justification or between metaethics and ethics. To show that this is so, I first give a general characterization of the various components of moral theory and of their relationships. I then argue that the use of particular methodological devices affect the very moral content of the theory. To characterize such incidence and its mechanisms, I first appeal to a pragmatic conception of explanation and, finally, I discuss two examples from contemporary moral theory showing that substantive moral claims so introduced, in fact fail to be justified. La question de l'allégeance morale au libéralisme politique occupe une place centrale dans la théorie de John Rawls. J'arguerai d'abord que, dans la conception de Rawls, le moral et le politique entretiennent un rapport paradoxal qui risque de compromettre l'institutionnalisation de la raison publique telle que Rawls la conçoit. Je proposerai ensuite une nouvelle définition des conditions de l'allégeance morale au libéralisme politique. J'arguerai que ma définition, tout en évitant la tension relevée chez Rawls entre le politique et le moral, (...) est aussi mieux adaptée aux représentations contemporaines du citoyen en tant qu'agent moral et plus conforme aux intuitions courantes concernant le rôle de la moralité dans une démocratie constitutionnelle.The problem of the moral allegiance to political liberalism is central in the theory of John Rawls. It will be argued first, that, as Rawls conceive them, the moral and the political practically stand in a paradoxical relationship which undermines the possibilities for the implementation of "public reason". A new characterization of the conditions of moral allegiance will be articulated. I will then argue that my characterization removes the tensions between the moral and the political I noticed in Rawls. It also yields a better understanding of the actual representation of the citizen as a moral agent and finally, gives a more accurate account of the role of morality in contemporary constitutional democracies. Plutôt que de fonder le concept à partir de l'intuition, l'auteur propose de le fonder à partir du concept. Il s'appuie sur la pensée de Bolzano, pour en faire le principe d'une lecture de Kant, Husserl, Schlick et Wittgenstein.

L'époque, selon certains, serait celle de l'espace, après l'effondrement des grandes eschatologies historiques. L'espace a, on l'oublie, une histoire. Quant à l'histoire, elle trouverait dans sa mise en relation avec les discours de la spatialité (architecture, écologie, géographie), les moyens de s'inscrire dans l'effectivité.

In absence of effective pharmaceutical treatments, the individual's compliance with a series of behavioral recommendations provided by the public health authorities play a critical role in the control and prevention of SARS-CoV2 infection. However, we still do not know much about the rate and determinants of adoption of the recommended health behaviors. This paper examines the compliance with the main behavioral recommendations, and compares sociocultural, psychosocial, and social cognitive explanations for its variation in the French population. Based on the current (...) literature, these 3 categories of factors were identified as potential determinants of individual differences in the health preventive behaviors. The data used for these analyses are drawn from 2 cross-sectional studies conducted after the lockdown and before the peak of the COVID-19 epidemic in France. The participants were drawn from a larger internet consumer panel where recruitment was stratified to generate a socio-demographically representative sample of the French adult population. Overall, the results show a very high rate of compliance with the behavioral recommendations among the participants. A hierarchical regression analysis was then performed to assess the potential explanatory power of these approaches in complying with these recommendations by successively entering sociocultural factors, psychosocial factors, social cognitive factors in the model. Only the inclusion of the cognitive variables substantially increased the explained variance of the self-reported adoption of preventive behaviors, providing better support for the social cognitive than the sociocultural and psychosocial explanations. La theorie de la signification a joue un role central dans le developpement de la phenomenologie. Jocelyn Benoist essaye d'en donner un expose systematique, y decelant le paradoxe que represente l'influence decisive d'un auteur qui n'utilise pas le concept d'intentionalite (Bolzano), relu et reinterprete par Husserl au moyen de ce meme concept. L'oeuvre de Husserl se situe au croisement de Bolzano et de Brentano, d'une pensee du sens et d'une pensee de l'acte, de l'objectivisme logique et de la description (...) psychologique et pragmatique: c'est le principe de lecture adopte ici. Cette enquete sur la theorie de la signification de Husserl conduit a revisiter tous les lieux classiques de la philosophie du langage et de la logique contemporaine, mis en vedette depuis par la philosophie analytique: theorie du sens, de la grammaire, de la verite, de la proposition, du nom propre, de l'indexicalite, des performatifs, etc. On mesure ainsi le point auquel la pensee de Husserl etait deja installe de plain-pied dans ces problematiques, et ce qu'elles-memes ont, aujourd'hui, a gagner a un retour sur elle. L'idée d'une origine commune de la phénoménologie et de la philosophie analytique commence à être bien admise. On essaie ici de lui donner quelque consistance en la mettant à l'épreuve d'une question, qui fut décisive pour les auteurs à la source de ces deux traditions, à la fin du XIXème siècle et au début du XXème : celle de la référence manquante ou des " objets inexistants ". On montre comment ce problème a pu orienter d'un côté les débats internes (...) à l'école brentanienne (Brentano lui-même, Twardowski, Meinong, le jeune Husserl), et de l'autre les réflexions des auteurs sources de la tradition dite analytique (Bolzano, Frege, Russell). Par opposition à d'autres études plus " syncrétiques ", il s'agit avant tout, dans la démarche adoptée, de mettre en avant des différences. D'abord au sein de l'école intentionaliste, beaucoup plus diversifiée et traversée de tensions qu'on ne le croit souvent. Puis, aussi et surtout, entre cette école et les auteurs qui ont choisi délibérément une autre voie : Frege et Russell, bien sûr, mais aussi déjà Bolzano. Il s'agit par là même de mesurer un écart qui devait s'avérer déterminant pour toute la philosophie du XXème siècle et de mieux définir le champ propre de cette philosophie. (shrink)

Animal production, especially pork production, is facing growing international criticism. The greatest concerns relate to the environment, the animals’ living conditions, and the occupational diseases. But human and animal conditions are rarely considered together. Yet the living conditions at work and the emotional bond that inevitably forms bring the farm workers and the animals to live very close, which leads to shared suffering. Suffering does spread from animals to human beings and can cause workers physical, mental, and also moral suffering, (...) which is all the more harmful due to the fact that it is concealed. The conceptual tools used to conceal suffering ( animal welfare, stress, pain) suggest that the industrial system can be improved, whereas for farmers it is by definition incompatible with animal husbandry.
